If Ms. Sheehan was manhandled like she says, and wasn't in the act of resisting arrest at the time then she has every right to sue. However, if she was not only resisting arrest, but is now intending to sue the government for arresting her for intentionally breaking a law she was warned about prior to her entry to the capitol building then I think her legal standing will be dismissed by whatever court she takes the case to; that is unless she decides to sue the government by proxy out of California.
